These Terms of Service ("Terms") govern your use of buildflownw.com (the "Site") and the services offered by BuildFlow AI LLC ("BuildFlow AI," "we," "us," or "our") (the "Services"). By accessing the Site, creating an account, starting a free trial, or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. The Services
BuildFlow AI provides AI-powered lead recovery, automated SMS response, AI text qualification, automated follow-up, Google review automation, and related tools for contractors and small business operators. Features available to you depend on the plan you select.
2. Eligibility
You must be at least 18 years old and authorized to enter into binding agreements on behalf of yourself or the business you represent to use the Services.
3. Account Registration
When you create an account or start a free trial, you agree to:
Provide accurate, current, and complete information
Maintain the security of your account credentials
Notify us immediately of any unauthorized use
Be responsible for all activity that occurs under your account
4. Free Trial
We offer a 30-day free trial. To start your free trial, you must provide valid payment information. You will not be charged during the trial period. At the end of the 30-day trial, your card will be automatically charged the recurring monthly subscription fee for the plan you selected unless you cancel before the trial ends.
You may cancel at any time during the trial period at no cost by contacting [email protected] or using the cancellation method provided in your account.
5. Subscription, Billing, and Cancellation
Plans and pricing. Current public plans are BuildFlow Essential at $497 per month and BuildFlow Premium at $897 per month. Pricing is subject to change with notice. Any change will not affect your existing billing cycle.
Billing. Subscriptions are billed monthly in advance to the payment method on file. By providing payment information, you authorize BuildFlow AI to charge your payment method on a recurring basis.
No setup fees. No long-term contracts. Subscriptions are month-to-month.
Cancellation. You may cancel your subscription at any time. To cancel, email [email protected]. Cancellation takes effect at the end of your current billing cycle. You will retain access to the Services until the end of that cycle. We do not provide refunds for partial months.
Failed payments. If a payment fails, we may suspend or terminate your access to the Services until payment is resolved.
6. Acceptable Use
You agree NOT to:
Use the Services for any unlawful purpose
Send spam, unsolicited messages, or messages prohibited by the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, or any other applicable law
Attempt to gain unauthorized access to the Services, other accounts, or our infrastructure
Reverse-engineer, decompile, or attempt to extract the source code of the Services
Resell, sublicense, or redistribute the Services without our written permission
Use the Services to harass, defame, or harm any person
Upload viruses, malware, or other harmful code
Interfere with or disrupt the Services
You are solely responsible for your compliance with all laws governing your communications with your customers, including obtaining proper consent before contacting them.
7. Your Content and Customer Data
You retain ownership of any content, lead data, customer information, and communications you upload to or generate through the Services ("Your Content"). You grant BuildFlow AI a limited license to use Your Content solely to operate, maintain, and improve the Services for you.
You represent and warrant that you have all necessary rights and consents to upload, process, and communicate with the contacts in Your Content, and that doing so does not violate any law or third-party right.
8. SMS and Communications Compliance
You acknowledge that the Services include automated SMS messaging. You agree to:
Obtain proper consent from your customers before BuildFlow AI sends SMS messages on your behalf
Honor all opt-out requests (STOP, UNSUBSCRIBE, CANCEL, etc.)
Comply with all applicable laws, including the TCPA, CTIA guidelines, and carrier requirements
Not use the Services to send prohibited content (SHAFT — Sex, Hate, Alcohol, Firearms, Tobacco — or other carrier-restricted content) unless explicitly permitted
Violation of these requirements may result in immediate suspension of the Services and is grounds for termination.
9. Third-Party Services
The Services integrate with third-party platforms (such as Stripe for payments, Google for reviews, telecommunications carriers for SMS). Your use of these third-party services is subject to their own terms and privacy policies. BuildFlow AI is not responsible for third-party services.
10. Intellectual Property
The Services, including all software, designs, logos, and content provided by BuildFlow AI, are owned by BuildFlow AI LLC and protected by intellectual property laws. Except for the limited rights granted to you to use the Services, no other rights are granted.
11. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
BuildFlow AI does not guarantee that:
The Services will be uninterrupted, error-free, or secure
Any lead, call, or message will be successfully delivered or recovered
The Services will achieve specific business results for your operation
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, BUILDFLOW AI LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO BUILDFLOW AI IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
13. Indemnification
You agree to indemnify and hold harmless BuildFlow AI LLC, its officers, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Services, your violation of these Terms, or your violation of any law or third-party right — including any claims related to your communications with your customers.
14. Termination
We may suspend or terminate your access to the Services at any time, with or without notice, for any violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the Services ends immediately. Sections that by their nature should survive (Sections 7, 10, 11, 12, 13, 15, 16) will survive termination.
15. Governing Law and Disputes
These Terms are governed by the laws of the State of Washington, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the Services shall be resolved in the state or federal courts located in Cowlitz County, Washington, and you consent to the jurisdiction of those courts.
16. Changes to These Terms
We may modify these Terms at any time. Material changes will be communicated through the Site or by email. Continued use of the Services after changes take effect constitutes your acceptance of the revised Terms.
